The challenge in all these writ petitions involves a common issue therefore, they are being heard and decided by common order. 2. For ready reference the facts of the WPS No. 160/2016 is taken under consideration. 3. The petitioners have filed these writ petitions seeking following relief(s):- 10.1 That this Hon’ble Court may kindly be pleased to call the records in the interest of justice. 10.2 That, this Hon’ble Court may kindly be pleased to issue any appropriate writ, directing or orders, directing the respondents to continue with the already appointed part time sweepers in the interest of justice. 10.3 That, this Hon’ble Court may kindly be pleased to grant any other relief or pass such other and further orders as may be deemed fit and proper in the facts and circumstances of the present case in the interest of justice. 4. Learned counsel for the petitioners submits that petitioners were appointed in different schools as part time sweepers. He submits that rationalization policy was introduced by the respondent/ State on 24.08.2015 (Annexure P-6) and various schools were directed to be rationalized in accordance to that policy. He submits that services of the petitioners were orally terminated and they were not considered as 15 per rationalization policy (Annexure P-6) in some other schools, therefore, these writ petitions were filed seeking for the relief as claimed. 5. Learned counsel for the respondent/ State submits that the petitioners were only appointed as part time sweepers and as per return filed by the State Government there is no rule guidelines governing appointment and service conditions of part time sweepers and despite communication made by State Government on 08.03.2011 and 04.07.2011, the respective Principals/ Head Masters proceeded to make appointment on their own and have thus, appointed the petitioners by pick and choose method. In order to avoid misuse of power at the level of Head Master/ Principal, the Collectors of State were directed to frame guidelines for appointment of part time sweepers. He submits that since the services of the petitioners were not required, therefore they were terminated. 6. Mr. Acharya submits that for the present, the grievance of the petitioners would be redressed, if they may be permitted to make representation to the concerned which may be decided by the concerned authority in accordance with law. 7. Not opposed by State counsel.
Decision
8. Be that as it may, the instant petitions are disposed of and petitioners are permitted to make a fresh representation ventilating their grievances to concerned authorities within a period of 60 days. On such representation having been made, the concerned authority shall decide the same within further period of 120 days from the date of receipt of representation. 9. This Court has not expressed any opinion on merits of the case. 10. With above observation, the writ petitions are finally disposed of.
