JUDQMENT (Delivered on this day of 6th October 2009) This jail appeal has been preferred by the appellant against the judgment of conviction and order of sentence dated 16-11-1999 passed by the Special in Special Case No. 4/1999, whereby the Judge (NDPS Act accused/appsllant has been convicted under Section 20 (B)(1) of the NDPS Act, 1985 and sentenced to undergo R.l. for two years. ) Raigarh, 2) On perusal of the record, it is clear that a report regarding present status of the appellant was sought frnm the concerned jail authorities by this court fhe aforesaid order, The vide order dated 6-8-2009. In corrpliance of Superintendent, Central Jail, Bilaspur has sent a report enclosing the report Superintendent, District Jail, Raigarh, wherein it has been stated that accused/appeltant has already been released from jail on 14-6-2000 in pursuance of order No.F.11-4-99/3 issued by Jail Department, Govt. of M.P, Fax No. 13160 of Jail Head Quarter, Bhcpal & Page No.735 dated 13-6-2000 of by giving him the benefit of speuai remission, which is also Central Jail, verified by the State counsel. 3) In view of the above report, the appeal is accordingly disposed of without entering into the merits of the case.
