JUSTICE MIHIR KUMAR JHA ORAL ORDER 2/ 21-08-2013 Heard learned counsel for the parties as with regard to the following relief prayed in this writ application: For “(i) authorities for pay fixation after due respondent directing the grant of pay protection in the basic pay scale of Rs.23,590/- with the grade pay of Rs.4800/- w.e.f. 23.3.2013, which is the date of joining. (ii) For payment of current salary, which is due since the date of joining.” Learned counsel for the petitioner in support of the aforementioned prayer has submitted that once the petitioner was sought to be absorbed on the post of Non-medical Assistant

Patna High Court CWJC No.15941 of 2013 (2) dt.21-08-2013 he would be at least entitled for his pay 2 fixation and pay protection on the absorbed post of Non-medical Assistant by giving him the basic pay of Rs.23,590/- with grade pay of Rs.4800/-. In this regard it has been submitted that the petitioner’s earlier service in the Bihar State Construction Corporation since 28.3.1977 cannot be ignored. Attention of this Court in this regard has been also invited towards paragraph no.13 of the writ application, relevant portion whereof reads as follows: “13. ... ... ... Thus, petitioner becomes entitled for absorption w.e.f. 4.9.1996 on which date illegally the claim of the petitioner for absorption has been rejected and that is accepted then the petitioner ought to be granted pay protection from the said date and accordingly the petitioner has represented annexing with the calculation w.e.f. 4.9.1996 that prima facie makes out a case for fixation of pay scale of the petitioner in the pay scale of Rs.9300-34800/- at the grade pay of Rs.4800/- and thus would be entitled for basic pay of Rs.23590/- with grade pay of Rs.4800/-.” Additionally, the learned counsel for the petitioner has also submitted that the payment of salary of the petitioner has not been made on account of non-issuance of Last Pay Certificate and the approval of pay fixation statement by Patna High Court CWJC No.15941 of 2013 (2) dt.21-08-2013 the Director-in-Chief of the Health Services. 3 In the considered opinion of this Court the petitioner will not be entitled for any pay fixation, inasmuch as though the word used in the order of his absorption dated 13.3.2013, as contained in Annexure 11, passed by the Director-in-Chief of the Health Services is Samayojan (adjustment) but in effect the petitioner has been sought to be appointed afresh in the State Government service. The Bihar State Construction Corporation in fact was a separate Government company and the petitioner, as noted above, was working as a Typist in the said Company from March, 1977. Thus, only because of some of the Government Corporation became sick and if the Government had taken a decision to adjust the employee of such sick Corporation they cannot claim pay protection and would be bound by the terms and conditions of appointment even by way of absorption or adjustment. ns; ugha gksxk Jh “kekZ ds osru dk Hkqxrku muds izFke osru foi= The joining of the petitioner thereafter has also been accepted with effect from 23.3.2013 under the order of the Civil Surgeon cum Chief Medical Officer, Muzaffarpur, contained in his memo No. 796 dated 1.4.2013 (Annexure 12) wherein the terms and conditions of his appointment has been reiterated in the following terms: ^^ funs”kd izeq[k] LokLF; The pay and emoluments of the petitioner, therefore, will be strictly abide by the order passed by Patna High Court CWJC No.15941 of 2013 (2) dt.21-08-2013 the Director-in-Chief of the Health Services 8 dated 13.3.2013 as reiterated by the Civil Surgeon in his order dated 1.4.2013. Now that the joining of the petitioner has already been accepted with effect from 23.3.2013 he will be entitled for payment of his salary from the aforesaid date. The office of the Civil Surgeon, Muzaffarpur, therefore, must send the pay fixation statement of the petitioner to the office of the Director-in-Chief of the Health Services within a period of 15 days from the date of receipt of this order by him and the Director-in-Chief of the Health Services must countersign the same after recording his approval within 15 days of its receipt from the office of the Civil Surgeon. Once the countersigned pay fixation statement of the petitioner is received from the office of the Director-in-Chief of the Health Services in the office of the Civil Surgeon, Muzaffarpur he would direct the In-charge Medical Officer, Primary Health Centre, Kurhni to ensure the actual payment of salary of the petitioner with effect from 23.3.2013 within the shortest possible time but in no event beyond a period of one month from the date of such order by the Civil Surgeon.
