JUSTICE AKHILESH CHANDRA ORAL ORDER 3 24-07-2012 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. Petitioners are named accused in this case being in-laws of the deceased sister of the informant who died within four years of her marriage under unnatural circumstances after suffering a lot and even dead body was disposed of hurriedly without waiting for arrival of her parents or due intimation to them. Submission is of false implication and prosecution side also participated in her last rites on her death due to sudden illness. Moreover, husband is in custody since 14.11.2011. Petitioners are in custody since 23.3.2012 on refusal of privilege under Section 438(2) of the Code of Criminal Procedure. Having regard to the facts and circumstances, the 2 petitioners are directed to be enlarged on bail on each furnishing bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara, in Piro P.S. Case no. 68 of 2011, with the condition that the petitioners shall remain present before the Court below on each and every date till disposal of the case. In the event of failure to attend the court on two consecutive dates, without any reasonable explanation, the privilege granted shall be deemed to be cancelled. A.Ahmad/- (Akhilesh Chandra, J)
