The petitioner being LLB cannot claim to be holding the equivalent qualification so as to enable her to become a Teacher in Middle School. The LLB course even if it be of five years, subjects of arts like History, Geography, Economics being taught therein are not of the graduation Patna High Court CWJC No.17825 of 2012 (2) dt.19-07-2013 6 level, inasmuch as, the entire emphasis in such L.L.B. course is on law

papers. The submission of the learned counsel for the petitioner that in the first year of five years L.L.B. course subject like History, Economics, Political Science are also taught will not make his qualification equivalent to Bachelor of Arts (B.A.), inasmuch as, the emphasis in the B.A. three years course on the subject like History, Economic, Sociology is by way of three papers of those subjects whereas in the LLB only a preliminary introduction of subject are being taught. The petitioner’s passing of the Teachers Eligibility Test, therefore will not make him qualified if he lacks the initial educational qualification. The appointment of the petitioner on the post of teacher in a High School was permissible only if he possesses the requisite qualification as laid down in the Rules and since the petitioner does not possess the prescribed qualification, his claim for such appointment is factually incorrect and legally impermissible. Be that as it may, this Court will be ill equipped to compare the qualification and must hold the writ application to be misconceived because B.A. cannot be equivalent to LLB for the post of appointment of a Teacher. Reference in this connection may also be usefully made to the division bench judgment in the case of Satyendra Singh & Ors. Vs. Sanjay Kumar & Ors. reported in 2001(1) PLJR 104 wherein it was held as follows:- "12. Prescribing qualification for a particular post by the competent authority is a policy decision. the Patna High Court CWJC No.17825 of 2012 (2) dt.19-07-2013 7 Government frames a policy after taking into consideration the number of facts and circumstances, expect opinion and other relevant considerations. The power of judicial review in such matters is limited. The Court can interfere only when the authorities have acted arbitrarily or in violation of the statutory or constitutional provisions. The Court does not sit as an appellate forum in disguise over the policy matter. It has no power to re- frame the policy matter and in case the policy matter is found suffering from any legal infirmities as indicated above, then the same is to be struck down and the matter is sent to the authority to consider the policy matter in accordance with the law laid down. If the rules have been framed prescribing the qualification for a particular post, the court has no power to re-frame the rules or supplement the rule by adding additional qualification for the simple reason that that is a function of the appointing authority and in the case of any legal lacuna the Court can only direct the appointing authority to consider the matter on the basis of the expert opinion and other relevant consideration. The Court cannot on the basis of the documents appended with the affidavit determine the equivalence or addition of qualification in the recruitment rules." That being so, this application has no merit and is, accordingly, dismissed. Rishi/- (Mihir Kumar Jha, J)
