2 17-04-2013 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner seeks bail in a case which has been registered for offences under Sections 304B and 201/34 of the Indian Penal Code. Two other persons are also accused in this case. It has been alleged that informant’s sister Lilawati Devi has been strangulated to death and her dead body was burnt. It has further been alleged that the petitioner was contacted another marriage and he was raising demand of Rs.2 lacs. Submission is that it is apparent from the order of the learned Sessions Judge that independent witnesses namely Dinesh Verma, Yugesh Singh, Harendra Singh, Ramashish Singh and Chinta Devi were examined under Section 161 of the Cr.P.C. Patna High Court Cr.Misc. No.16481 of 2013 (2) dt.17-04-2013 and their unilateral version is that the deceased died due to some disease and for that some prescription have been annexed with this petition which shows the ailment and treatment of deceased Lilawati Devi. While opposing the prayer for bail of the petitioner, learned counsel for the State assisted by learned counsel appearing for the informant has submitted that there is allegation of torture. Considering the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad in Khudawan P.S.Case No. 52 of 2012.
