The petitioner in this writ application has prayed for the following relief:- “for quashing the Memo No. 237 dated 29.11.2011 (Annexure-17) passed by Special Director (Secondary Education) respondent no.2 and to direct the respondent no.3 and 4 for approval of selection of the petitioner by respondent no.5 after removing the illegality appointed person (Respondent no.8)” 3. Learned counsel for the petitioner has submitted that the Special Director (Secondary Education) has committed an error both on fact and in law while passing the impugned order Patna High Court CWJC No.17959 of 2012 (2) dt.25-07-2013 2 dated 29.11.2011 holding the petitioner to be ineligible for appointment on the post of Sanskrit Teacher in a recognized private Sanskrit high school. According to him, since the petitioner was already M.A. in Sanskrit, she will be deemed to have the qualification for appointment on the post of Sanskrit Teacher. 4. Learned counsel for the respondents on the other hand has pointed out that the advertisement itself had prescribed the qualification for the post in hand laying down Acharya in Sanskrit subject to be compulsory for such appointment. According to them, since the petitioner did not possess the qualification of Acharya, her appointment made by the Governing Body of the school was itself bad and that was not approved by the Board, whereafter, such decision of the Board was also affirmed in appeal by the Special Director in the impugned order. 5. In the considered opinion of this Court such submission of learned counsel for the Respondent has to be accepted for more than reason. Firstly in a recognized private Sanskrit school, the Government has laid down staffing pattern. Such staffing pattern has to be only for the purposes of the Government extending full financial support for payment of salary against these posts. It is in this background that the Government Patna High Court CWJC No.17959 of 2012 (2) dt.25-07-2013 3 for the post of Teacher in the recognized private Sanskrit high school has laid down that there would be four posts of Teachers of the Sanskrit subjects and they must be having qualification of Acharya. Even there it has been made clear that Acharya in the subject of vk;qZosn will not qualify for the appointment on the post of Sanskrit Teacher. In the same Government circular laying down staffing pattern, there are also posts of teachers for non Sanskrit subject for which also qualification has been laid down. The aforesaid Government circular contained in Resolution no. Secondly the advertisement, in question, was issued by the Managing Committee of the school only on the basis of the aforementioned government circular, inasmuch as, any post filled up contrary to the qualification laid down in the government circular could not have been approved by the Board and thus, the appointment of the petitioner made by the Managing Committee Patna High Court CWJC No.17959 of 2012 (2) dt.25-07-2013 6 of the school could not have been recognized much less approved by the Board for the purpose of payment of salary on the basis of the fund released by the Government. 7. Therefore, if the Managing Committee of the school had wrongly appointed the petitioner despite her not possessing the requisite qualification and infact contrary to the terms of advertisement the action of the Board of not approving such appointment of the petitioner and the consequential order of the Special Director of the State Government in exercise of appellate power under Section 24 of the Bihar Sanskrit Shiksha Board Act, 1981 cannot be said to be erroneous either on fact or in law wherein it has been held as follows:- ^^vfHkys[k ls Li"V gS fd foKkiu dsoy nks vkpk;Z f’k{kd dh fu;qfDr dk FkkA ml foKkiu esa ;ksX;rk dsoy vkpk;Z Fkh u fd led{k ;ksX;rkA vihykFkhZ dh ;ksX;rk M.A. laLd‘r ftls fcgkj ljdkj vkpk;Z ds led{k ekuk gS vH;fFkZ;ksa esa vkpk;Z ;ksX;rk/kkjh Fks] blfy, izca/k lfefr us izfroknh la[;k&7 dh fu;qfDr dk izLrko dk vuqeksnu gsrq fcgkj laLd‘r f’k{kk cksMZ dks HkstkA cksMZ us vius Kkikad&399 fnukad 10-02-2010 ds }kjk izca/k lfefr ds izLrko dks vuqeksnu fn;k tks lgh gSA mijksDr rF;ksa ds vk/kkj ij vihy [kkfjt fd;k tkrk gSA** 8. The reliance placed on government circular dated 29.03.1963 (Annexure-14) laying down Acharya (with English at Shastri Stage) to be equivalent to M.A. Sanskrit and another Patna High Court CWJC No.17959 of 2012 (2) dt.25-07-2013 7 circular dated 11.4.1983 (Annexure-15) will also be of no two avail for two reasons. Firstly they relate to equivalence of Acharya qualification whereas there is no provision in the staffing pattern dated 29.6.1961 for an equivalent qualification, meaning thereby Acharya qualification holders alone can be appointed on the post of teachers for Sanskrit subject in recognized Sanskrit High School. Secondly the circular dated 29.6.1963 (Annexure-14) is confined to equivalence of such qualification from Kameshwar Singh Darbhanga Sanskrit University whereas other circular dated 11.4.1983 is with regard to equivalence of qualification acquired from Sampurnand Sanskrit University whereas the qualification of M.A. Sanskrit has been acquired by the petitioner from Mahatma Gandhi Kashi Vidyapeeth, Varanasi for which there is no such circular issued by the State Government of Bihar. 9.
