JUSTICE SHIVAJI PANDEY ORAL ORDER 2 22-05-2012 Heard learned counsel for the petitioners and learned counsel for the State. The petitioners apprehend arrest in connection with Bikramganj P.S. Case No. 165 of 2011 for the offences punishable under Sections 379 of the Indian Penal Code and 135 of the Electricity Act. It has been alleged that the petitioners were using energy by committing theft and a bill of Rs.42,735/- from each petitioner was raised. The petitioners are ready to deposit the full amount in five easy instalments. If the petitioners deposit the first installment within 15 days from today no coercive steps shall be 2 Patna High Court Cr.Misc. No.19238 of 2012 (2) dt.22-05-2012 taken against the petitioners but after completion of five instalments at the end, in the event of arrest or surrender the abovenamed petitioners are directed to be released on anticipatory bail on their furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Bikramganj (Rohtas) in connection with Bikramganj P.S. Case No. 165 of 2011 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure. Vinay/- (Shivaji Pandey, J)
