JUSTICE PRABHAT KUMAR SINGH ORAL ORDER Mr. Manoj Kumar Pandey, Advocate Mr. Pushpa Sinha, A.P.P. 6 01-05-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under sections 147, 149, 341, 323, 448, 307, 354, 427 and 504 of the Indian Penal Code. As per the prosectuion case, all the FIR named accused persons including this petitioner entered the house of the informant and co-accused persons named Kunal Paswan and Babloo Paswan assaulted him by means of lathi, on his leg and body, and petitioner Nago Paswan assaulted with iron rod upon his head. They also assaulted his cousin named, Nitish Kumar. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case due to village politics. It is further submitted that the Patna High Court CR. MISC. No.72868 of 2022(6) dt.01-05-2023 parties are agnates and there is a land dispute between them. There present case is counter blast of the case filed by the petitioner just to save their skin this false and fabricated case has been registered against the petitioner. Doctor has found simple injury. Learned counsel for the State opposes the bail petition of the petitioner. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. I in connection with Barh P.S. Case No. 233 of 2020 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure. Alok Verma/- U T (Prabhat Kumar Singh, J)
