JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 2 21-10-2013 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner apprehends his arrest in a case registered for the offences punishable under various sections of the Indian Penal Code including section 307. As per the prosecution story, the allegation is that the petitioner and others assaulted the informant with iron rod and bricks causing head injuries. Learned counsel for the petitioner has drawn my attention to the injury report, according to which, the injuries have been found to be simple in nature and according to him it falsifies the prosecution case. He further submits that there is counter version of the prosecution story and another case being Kako PS case No. 117/13 has been filed by the petitioner against the informant and his family members. Keeping in view the nature of the allegation and the Patna High Court Cr.Misc. No.43831 of 2013 (2) dt.21-10-2013 fact that there is counter version of the same story, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today be released on bail on his furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jehanabad in Kako P.S. case No. 116/2013, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.
