No.1558 of 2007 stood dismissed due to delayed compliance of the order dated 24.2.2011 passed by this Bench. He submits that peremptory time expired on 10.3.2011, but Interlocutory Application for substituted service was filed on
11.3.2011 and mistake occurred due to wrong calculation of date by learned counsel appearing on behalf of the petitioner. After having heard the parties, and for the reasons disclosed in the present M.J.C. application, prayer for restoration is allowed. C.R. No. 1558 of 2007 is directed to be restored to its original file. Let C.R. No. 1558 of 2007 be listed under appropriate heading for appropriate orders for substituted service, before the concerned Bench, as per roster of this Court, after obtaining necessary permission from Hon’ble the Chief Justice. Henceforth,. the aforesaid C.R. No. 1558 of 2007 shall no longer be treated as part heard or tied up matter to this Bench.
