JUSTICE CHANDRA PRAKASH SINGH Mr.Dhanesh Shankar Vidyarthi Mr.Kumar Veerendra Narayan ORAL ORDER 2 08-06-2022 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Learned counsel for the petitioner is permitted to remove the defect(s), as pointed out by the office, if any, within a period of three weeks on resumption of physical mode. The Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 143, 323, 307, 354, 504 and 379 of the Indian Penal Code. The petitioner is alleged to have assaulted and abused the informant. The petitioner also assaulted on the head of the informant and on the thumb of his mother with Daab. Learned counsel for the petitioner has submitted that similarly situated co-accused person has already been granted Patna High Court CR. MISC. No.70205 of 2021(2) dt.08-06-2022 bail by a coordinate bench of this court vide order dated
16.04.2021 passed in Cr. Misc. No. 38070 of 2020. Although injury is simple in nature and the petitioner has no criminal antecedent. Learned A.P.P. for the State has opposed the bail petition of the petitioner. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Chapra (Saran) in connection with Chapra Muffassil P.S. Case No. 382 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further condition that the petitioner is directed to remain physically present before the learned court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
