JUSTICE GOPAL PRASAD ORAL ORDER 3 03-12-2012 Heard learned counsel for the petitioner and learned counsel for the State. This is a petition for grant of regular bail in a case under Sections 323 and 498(A) of the Indian Penal Code as well as Section 4 of the Dowry Prohibition Act 1961. Learned counsel for the petitioner submits that the petitioner is ready to pay maintenance to the informant as fixed by the learned Family Court, Jehanabad in Misc. Case No. 35 of 2012. Hence, having regard to the facts and circumstances of the case, the petitioner above named is ordered to be released on provisional bail for six months on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad in connection with Complaint Case No. 289 of 2007, subject to the condition that the petitioner shall go on paying the maintenance as fixed by the learned Family Patna High Court Cr.Misc. No.46461 of 2012 (3) dt.03-12-2012 Court, Jehanabad passed in Misc. Case No. 35 of 2012 and shall clear the dues amount of maintenance or arrear within six months from the date of his release. This order shall be subject to the order passed by the learned Family Court, Jehanabad either in enhancement or reduction of maintenance. Kundan/- (Gopal Prasad, J.)
