2. It has to be noted that the competent authority pursuant to direction of this Court in the order dated 22.7.2011 in C.W.J.C. 3. Learned Counsel for the petitioner has not been able to demonstrate any factual error in the impugned order. He had howeve concentrated on the two aspects namely that the petitioner had completed a period of more than ten years service prior to his services being terminated on 1.8.1991 and further the documents showing such working of the petitioner had to be traced by the Principal Secretary from the concerned offices where the petitioner had worked prior to termination of his service.

Learned Counsel for the State has submitted that the claim of the petitioner that he was engaged on muster Roll since 1973 and had continued in service till 1.8.1991 seems to be absurd because when the writ petitioner himself claims to be aged about 50 years on the date of filing of this writ application on 4.4.2013 it would mean that his Patna High Court CWJC No.7141 of 2013 (2) dt.03-05-2013 5 such engagement was made when he was only 10 years old. He has further submitted that the petitioner’s alleged service record in the various field offices of Mines department in the State of Jharkhand could not have been summoned in a routine manner by the Principal Secretary when the petitioner had failed to produce even his appointment letter and various orders of his transfer and/or movement. According to him it was a wholly State Claim of petitioner which was rightly rejected.

5. From the materials on records as also the above noted submissions it is more then clear that the petitioner had failed to establish his claim of being engaged even on daily wages in 1973. The petitioner as per own showing was only 10 years of age in 1973 and therefore when there is also nothing to support, not even his appointment letter, this Court would not find any error in the decision making process as would also be apparent from a bare perusal of the impugned order. As a matter of fact the petitioner has also failed to bring anything on record as with regard to his working on daily wages on sanctioned post Patna High Court CWJC No.7141 of 2013 (2) dt.03-05-2013 6 prior to his termination of service on

1.8.1991. The requirements of a sanctioned post and the appointment having been made by the competent authority after following the mandate of Article 14 and 16 of the Constitution of India are the two most important factors to be considered while examining the case of regularization as was held by the Constitution bench in the case of State of Karnataka Vs. Uma Devi(3) reported in (2006) 4 SCC 1.

The case of the petitioner for regularization is even other fully covered by a judgment of the Full Bench of this Court in the case of Ram Sevak Yadav vs The State of Bihar reported in 2013(1) PLJR 964, wherein it has been held as follows:- "We therefore conclusions and answer the reference as follows;- (A) Uma Devi (supra) prohibits regularization of daily wage, casual, ad-hoc and temporary appointments, the period of service being irrelevant; (B) An illegal appointment void abinitio made contrary to the mandate of Article 14 without open competitive selection cannot be regularized under any circumstances. (C)Irregular appointments can be regularized if the appointment was made by an authority competent to do so, it was made on a vacant sanctioned post, in accordance with Article 14 of opportunity participation constitution Patna High Court CWJC No.7141 of 2013 (2) dt.03-05-2013 7 eligible competitive others selection and the candidate possessed the eligibility qualifications for a regular appointment to the post. (D) The appointment must not have been an individual favour doled out to the appointee alone and the person must have continued in service without intervention of any Court orders."

From perusal of the impugned order passed by the Principal Secretary of the Mines Department, it is also clear that the petitioner was not only working on daily wages but his appointment was made without following the mandate of Article 14 and 16 of the constitution of India. Thus the following observations given in the case of Ram Sevak Yadav (supra):- "44. The petitioners were appointed in temporary capacity by a process contrary to Article 14 of Constitution without competitive selection individual favour doled out to them. There is no material to hold that they were appointed against vacant sanctioned possessed qualifications for the same. They were terminated before (Uma Devi) (supra) and have sought to retain their status by virtue of Patna High Court CWJC No.7141 of 2013 (2) dt.03-05-2013 8 Court proceedings and are therefore not entitled to the benefits of paragraph 53. The issue of any procedural irregularity a finding of forged appointment is therefore irrelevant." shall also apply with full force in the case of the petitioner.

8. That being so, this application raising a stale claim of regularization after more than twenty two years of his termination of service is wholly misconceived both on fact and in law and is, accordingly, dismissed. Ranjan (Mihir Kumar Jha, J)
