The grievance of the petitioner in this writ application can be better understood from the relief sought in this writ application which reads as follows:- “That the present application is for issuance of a writ in the nature of writ of mandamus for directing the respondent authorities to appoint the petitioner to the post of Assistant Teacher as per her seniority, in light of the guidelines issued vide memo no. 190 dated 13.03.2012 under the signature of the Director (Primary Education) Bihar, Patna as contained in Annexure-8 to this application”. clarification Mr. Banwari Sharma, learned counsel appearing on behalf of the petitioner has submitted that there was a clear indication given in the order of the Director, Primary Education as with regard to the recognition of the degree of Vidya Vinodini/Praveshika from Prayag Mahila Vidyapeeth, Allahabad. The petitioner having passed from Prayag Mahila Vidyapeeth, Allahabad cannot be held to be disqualified, inasmuch as, she had passed the examination in the month of May-1987. To that extent he has also assailed the subsequent decision circulated by the respondents as annexed in the counter affidavit contained in letter of the Principal Secretary in memo no. 3152 dated 25.02.2008, wherein, it has been held that the qualification of Vidya Vinodini acquired from Prayag Mahila Vidyapeeth, Allahabad would not qualify for appointment on the post of teachers in Bihar State. In the considered opinion of this Court, the moment it becomes clear that the petitioner is seeking appointment on the post of teacher in primary School in terms of Advertisement No. 210 of 2010, she has to fulfil the requisite qualification as laid down in the Rules framed for filling up such posts. A bare perusal of Rule-3(ii) would therefore, go to show that a person in order to be appointed as a teacher must have Intermediate qualification from School/College recognized by the Central Government or State Government. The first question, therefore, would be whether Prayag Mahila Vidyapeeth, Allahabad is recognized by the State Government of Uttar Pradesh or by the Central Government. Nothing has been brought on record of this case as with regard to the recognition of Prayag Mahila Vidyapeeth, Allahabad. As a matter of fact, the certificate of the petitioner issued by Prayag Mahila Vidyapeeth, Allahabad does not show that it was recognized by the State Government of Uttar Pradesh or by the Central Government. Secondly, it has to be also kept in mind that the qualification of Vidya Vinodini acquired by the petitioner is equivalent Patna High Court CWJC No.18164 of 2012 (2) dt.30-07-2013 7 to Intermediate qualification in a particular subject or not. Such qualification has been specifically debarred in terms of Rule-3(ii) for being eligible for the post of teacher. Thus, the clarification which has been issued in Annexure-A to the counter affidavit already quoted above, way back on 25.08.2008 notifying that Vidya Vinodini and its equivalence of matriculation would not qualify for appointment on the post of teacher in a primary School is a clear pointer to the fact that the petitioner does not possess the requisite qualification. As a matter of fact, when the petitioner has herself claimed in paragraph no. 4 that Vidya Vinodini passed by her in the year 1987 from Prayag Mahila Vidyapeeth, Allahabad was equivalent to matriculation, she would not even otherwise claim appointment on the post of teacher because even Rule-3(vi) envisages only such matriculate to be eligible who have passed two years teachers training course. The certificate annexed by the petitioner of Bihar School Examination Board showing her to have completed regular/short teachers training course in 1994 session will mean that she had undergone one year teachers training course and not two years teachers training course. 7. The claim of the petitioner that she had undergone teachers training course in the year Patna High Court CWJC No.18164 of 2012 (2) dt.30-07-2013 8 1990-1992 and had passed her examination in 1994 does not get support from the certificate. 8. Mr. Banwari Sharma, learned counsel for the petitioner, however, has sought to rely on the clarification issued by the Director, Primary Education dated 13.03.2012 and according to him since the petitioner had passed her Vidya Vinodini prior to 31.12.1987, she would be entitled to treat it as equivalent qualification of matriculation in terms of the circular issued by the Personnel and Administrative Reforms Department. First of all there is no circular of Personnel and Administrative Reforms Department brought on record which would go to show that the State Government of Bihar at any point of time recognized the degree of Vidya Vinodini to be equivalent to matriculation for the purpose of appointment on the post of teacher in the State of Bihar. Mere inference drawn on the basis of such clarification dated 13.03.2012 would also be of no avail, inasmuch as, such clarification in fact remains confined to Rashtriya Sansthan. There is nothing on record to show that Prayag Mahila Vidyapeeth, Allahabad is a Rashtriya Sansthan, inasmuch as, Rashtriya Sansthan can be declared only by Government of India and there is nothing on record of this case to show that the Government of India had ever declared Prayag Mahila Patna High Court CWJC No.18164 of 2012 (2) dt.30-07-2013 9 Vidyapeeth, Allahabad as Rashtriya Sansthan, in fact that would not be the end of the matter. So, far the qualification of Vidya Vinodini for appointment on the post of teacher is concerned the same has been clearly prohibited even in the Bihar Education Code which under Article-358 clearly lays down that certain qualification would be valid in the State of Bihar for appointment on different posts but not for appointment on the post of teacher but only for promotion of such working teachers. This would become more apparent from the reading of Article-358 of Bihar Education Code:- 358.Recognition of certificates from National Universities:- Examinations conducted by National Universities enumerated in the following table should be treated as equivalent to the degrees granted by a recognized University mentioned opposite each in column III and that candidate who have passed any of examinations mentioned in column 1 upto the end of the year 1965 or year mentioned against their names should be tested as eligible for appointment to a post or service under Government ( except to a post of teacher. In case of teachers valid for promotion only) for which success at any of the corresponding examination of a recognized University is laid down as qualification for appointment to that post or service. As would be apparent Bihar Education code has treated certain qualification to be equivalent for the purposes of appointment in Government service other than, for the post of teacher and in case of teachers the same was to be held valid only for the purposes of promotion. This was also available up to the year 1965. 10. From the reading of Article-358 of Bihar Education Code and specially the foot note given under table no. 2 and table no. 3, it would become clear that so far the qualification from table no. 1 institution is concerned that was treated to be equivalent for appointment in the Government of Bihar up to the year 1965. This becomes more clear from the foot note given at the end of table no. 2 where 11 institutions and their certificates of examination with equivalence were treated to be valid in the State of Bihar up to the year 1980. 11. As a matter of fact, the foot note at the end of table no. 3 as with regard to explanation of recognition is only in respect of the Patna High Court CWJC No.18164 of 2012 (2) dt.30-07-2013 12 qualification of Mandar Vidyapith and Hindi Vidyapith Deoghar and therefore, there is nothing to support the case of the petitioner that her Vidya Vinodini examination passed from Prayag Mahila Vidyapeeth, Allahabad in the year 1987 was treated to be equivalent to matriculation for the purposes of appointment on the post of teachers in the State of Bihar. 12. This becomes in fact more clear from the reading of Article-359 of the Bihar Education Code, which reads as follows:- "359. Appointment to teacher's post forbidden on the basis of equivalence of Certificates.- In order to raise the quality of teaching in school, it has been decided by the State Government that only those persons who have passed examinations held by the Bihar School Examination Board, Central Board of Education, Secondary Examination Boards of other State or Degrees obtained from statutory Universities shall be compulsory for appointment to the post of teachers in the Primary, Middle and High Schools. (2) For appointment to the post of Urdu, Arabic, Persian and Sanskrit teachers, for the first time, a candidate must have passed in respect of Urdu, Arabic, Persian from the Madrasa Examination Board, Bihar or from other recognized Institute by the Personnel Department, Government of Bihar, and in respect of Sanskrit from Kameshwar Singh Sanskrit University or Sampurnanand Sanskrit Vishwavidyalaya, Varanasi (U.P.) (Education Departments Resolution No. 394 dated 11-4-83.) (3) But if teachers of Primary, Middle and High Schools Pass examination equivalent to Intermediate, Graduate, and Post- Graduate Degrees whose equivalence is recognised by the Personnel Department as mentioned in the preceding Article, may be promoted to higher pay-scale beyond matriculation. This facility shall not be given to Middle trained teachers for getting Matric Patna High Court CWJC No.18164 of 2012 (2) dt.30-07-2013 13 trained pay-scale on the basis of equivalence. For getting Matric trained scale of pay, a Middle trained teacher must pass the Secondary School Examination from the Bihar School Examination Board. (Letter No. K/Ml-138/75/2680, dated 5th August, 1976 and letter No. 9/M3-286/85E 2205, dated 24th August, 1985.)" 13. Thus, in view of the provisions contained in Article-358 and 359 as also Rule-3 of 2010 Rules, there will be no difficulty in holding that the petitioner by virtue of her qualification of Vidya Vinodini obtained from Prayag Mahila Vidyapeeth, Allahabad did not possess the requisite qualification for appointment on the post of teacher in terms of Advertisement No. 210 of 2010 seeking to fill up 34540 post of teachers. 14. That being so, the prayer of the petitioner for issuance of a direction for her appointment on the post of assistant teacher against 34540 posts must be and is hereby rejected.
Decision
15. In the result, this application fails and is, accordingly, dismissed. Ranjan (Mihir Kumar Jha, J)
