13.01.2009. Heard the counsel for the petitioner and the State. Counsel for the petitioner submits that false allegation of realization of money from the beneficiary of ‘Indira Awas Yojna’ has been made against the petitioner. The petitioner’s name has been shown as an accused in the case. The beneficiary died much before the alleged enquiry, however, his wife has not supported the allegation. The petitioner is not any authority of the Panchayat or Block.. Considering these facts, the prayer for Anticipatory bail on behalf of Arun Safi is allowed. In the event of arrest or surrender within four weeks from today, the petitioner Arun Safi is directed to be released on Anticipatory bail on furnishing bail bonds of Rs.10,000/-((Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Jhanjharpur, Madhubani in connection with Laukahi P.S. Case No. 162 of 2007 subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. U.K. (Mridula Mishra,J)
