The prayer of the petitioner in this writ application reads as follows:- “For commanding and directing the concerned authority to consider and decide the claim of the petitioners for the regularization in terms of the policy decision of the State Government communicated under Memo No. 489 dated 10.05.05 whereby the cut off date for the regularization was extended from 01.08.1985 to 11.12.1990 or a list of persons who completed more then 240 days and appointed earlier to 11.12.1990.” Learned counsel for the petitioner has submitted that the petitioners have worked as Seasonal Amin for a period exceeding 240 days and all of them possessed the prescribed qualification for the post of Amin as would be evidenced from the list of Seasonal/daily wages employee prepared by the Executive Engineer of the Sone Canal Division, Ara dated 24.1.2007. On the basis of the same, learned counsel for the petitioners has submitted that the petitioners would be entitled for regularization of service in view of the Government resolution dated 10.5.2005. In the considered opinion of this court, the petitioners have some misconceived notion as with regard to the scheme of Patna High Court CWJC No.3237 of 2013 (2) dt.20-02-2013 3 regularization. The government had issued an order dated 18.6.1993 which is resolution no. 5940 dated 18.6.1993 wherein it had decided that the employees on daily wages engaged on or after 1.8.1985 should be removed from service and those continued in service as prior to 1.8.1985 will be given weightage in the appointment if they had completed 240 days service on daily wages. That resolution of the decision by the Personnel Administrative Reforms Department dated 18.6.1993 was partly modified by issuance of resolution dated 10.5.2005 wherein the only cut-off date was changed from 1.8.1985 to 11.12.1990. In fact, if the aforesaid scheme of the Government dated 18.6.1993 and its modification dated 10.5.2005 is understood in a correct manner, all that the same envisages is that every thing being equal, the daily wages employees continuing in service till 11.12.1990 shall be given weightage at the time of regular appointment. It nowhere envisages the straightway regularization of Seasonal Amin. In view of the above, this Court does not find any merit in this application and the same is accordingly dismissed. The dismissal of this writ application, however, will not come in the way of the petitioner to claim the benefit of weightage as per the government resolution dated 10.5.2005 as and when the post of Amin is advertised for regular appointment in Sone Canal Division, Ara.
