JUSTICE DINESH KUMAR SINGH ORAL ORDER 2 10-05-2012 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences under Sections 341,323,448,380,354,504 and 506/34 of the Indian Penal Code and Section 3(1)(x) (xi) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. The accusations are of committing theft, making assault and outraging modesty of the informant. It is submitted that there is no injury and the petitioners have lodged Complaint Case no. 1457 of 2011 against the informant side on 12.8.2011 when the present case was lodged on
15.8.2011 for the occurrence of 10.8.2011. Delayed lodging of the case clouds the bonafide of the accusation. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of 12 Patna High Court Cr.Misc. No.17497 of 2012 (2) dt.10-05-2012 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with S.C//S.T. P.S. Case No. 17 of 2011 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Anil/-
