Respondent/s ====================================================== CORAM: HONOURABLE JUSTICE SMT. SHEEMA ALI KHAN ORAL ORDER 2 26-02-2013 Heard Counsel for the petitioners and the respondents. This writ application has been filed challenging the order dated 25.09.2012 by which the Court below has rejected 4 Patna High Court CWJC No.3204 of 2013 (2) dt.26-02-2013 4 / 4 the application filed on behalf of the petitioners to be added as parties in Title Partition Suit No. 20 of 1993. The Court below has discussed the case of the parties, who are already parties in the suit i.e. the case of the plaintiff, written statement of the defendants and has concluded that no relief has been claimed against these petitioners. The petitioners basically want to challenge the partition between the family in 1927 in which the partition is between the larger family. At present, the partition is restricted to a single branch of the said family and as such, the Court below has found that there was no reason to add these persons as parties. Apart from the aforesaid facts, the application was verified in the year 2001 and has actually been filed and pressed in the year 2008, which speaks volumes about the conduct of these petitioners. It is well settled law that the plaintiff is the master of his case who is dominis litis and he cannot be compelled to add any person as party in this case, especially if he is not claiming any relief against such a person.
Decision
