Petitioner rushed to this High court to quash a communication dated 31.08.2007 made to the Divisional Commissioner by the District Magistrate, Motihari for initiation of an action under Section 18(5) of the Bihar Panchayat Raj Act, 2006. There is nothing to show that anything consequential to this communication has been done. Further the Divisional Commissioner now stands divested of his power under Section 18(5) by an amendment in the Act. In that view of the matter the writ application has lost its meaning unless a final order has already been passed by the Divisional Commissioner. The writ application is dismissed. Mkr.
