JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 15 02-12-2013 All the batch of cases is taken up together for hearing in Admission matter. In view of the peculiar facts and circumstances C.W.J.C. No. 12867 of 2013 and M.J.C. No. 4635 of 2013 (two cases) are separated and are posted under the heading “For Admission-I” on 10.12.2013. The petitioners in these batch of writ applications had challenged the transfer order dated 16.10.2008 issued by respondent no.3 cancelling the earlier transfer order dated 20.09.2008 by different memo numbers. The transfer is an incidence of service and no employee can claim to be posted at a particular place, as a matter of right. By an interim order of this Court, the petitioners have already continued at the transferred place for more than five years. Counsel for the petitioners rightly submits that these writ applications have become infructuous. 6 Patna High Court CWJC No.15667 of 2008 (15) dt.02-12-2013 Page 6 of 6 In the circumstances, all these writ applications are dismissed as having become infructuous except CWJC No.12867 of 2013 and M.J.C.
