Mandal --- Dated, the 7th November, 2008 After having heard the counsel for the petitioner, we are satisfied that the controversy raised in this writ petition, which has been filed in the nature of public interest litigation, does not require to be entertained by this court.

If the respondent no.10 has incurred any disqualification (pre-election or post election) as Mukhiya of Rajpur Panchayat in Rajpur Block, the Bihar Panchayat Raj Act, 2 2006, provides mechanism for removal of such candidate. Obviously, the process provided therein has to be followed.

In this view of the matter, we decline to entertain this writ petition. It is, accordingly, disposed of. However, this will not preclude the petitioner or any other affected person in prosecuting the remedy provided in the Bihar Panchayat Raj Act, 2006, against respondent no.10. R .M. Lodha, CJ.
