UMI SINGH @ UMA KANT SINGH v. THE STATE OF BIHAR

1959. The petitioners, who have been attributed with various weapons, are alleged to have damaged the vehicle of the informant and also demolished the boundary wall. They are alleged to have demanded a ransom amount of Rs. 10 lakhs. The learned Advocate for the petitioners has submitted that an absolutely false allegation has been foisted on them. There is counter version of the occurrence also for which petitioner no. 1 has filed a case vide Sultanganj P.S. Case No. 164 of 2020. In the aforesaid case, two persons from the side of the petitioners have received injuries. Except for petitioner nos. 4 and 8, all other petitioners have clean antecedents. The petitioner nos. 4 and 8 were earlier made accused in a case vide Sultanganj P.S. Case No. 99 of 2019 in which they have been granted bail. Regard being had to the afore-stated facts, the Patna High Court CR. MISC. No.10078 of 2021(2) dt.21-02-2022 petitioners, above-named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate -I, Bhagalpur, in connection with Sultanganj P. S. Case No. 165 of 2020, subject to the conditions as laid down under Section 438 (2) Cr.P.C. The application stands allowed. (Ashutosh Kumar, J) skm/- U T
