CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 3 30-08-2012 Heard learned counsels for the petitioners, informant and the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 354, 379, 307, 324 of the Indian Penal Code and 27 of the Arms Act. It is specifically alleged in the F.I.R. that the petitioner Santosh Kumar @ Munna resorted to firing. It is submitted by learned counsel for the petitioner Santosh Kumar @ Munna that during investigation, it is not alleged that this petitioner fired rather it is alleged that Himanshu Kumar caused fire arm injury. 2 Patna High Court Cr.Misc. No.24663 of 2012 (3) dt.30-08-2012 Since the specific accusation of firing is against the petitioner Santosh Kumar @ Munna, this Court is not inclined to grant anticipatory bail to him. Let the learned court below consider regular bail of petitioner Santosh Kumar @ Munna if he surrenders within a period of six weeks from the date of receipt of copy of this order. So far other petitioners are concerned, it is submitted that there is no specific accusation of firing against them and statement has been made in paragraph no. 10 of the petition that the petitioners have no criminal antecedent, let the petitioners Chandra Bhushan Kumar, Munder Rai and Mangal Rai @ Mangai Rai except petitioner Santosh Kumar @ Munna be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Maner P.S. Case No. 288 of 2011 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Danapur, Patna, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
