CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 3 07-11-2012 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. This application under Section 482 of the Code of Criminal Procedure is to quash the order dated 06.04.2010 passed in Complaint Case No. 8 C of 2010 by the Court of Sri Ghanshyam Singh, Judicial Magistrate, 1st Class, Lakhisarai whereby the learned Magistrate has summoned the accused- petitioners, on enquiry, finding prima case under Sections 323, 341, 379, 384 and 504 of the Indian Penal Code. Learned counsel for the petitioners submits that in fact, the petitioners had given application under Right To Information Act to the B.D.O. regarding the information relating to the irregularities committed by the complainant/opposite party Patna High Court Cr.Misc. No.14990 of 2010 (3) dt.07-11-2012 no. 2 being a fair price shop dealer. Due to that reason, this false complaint case has been filed against the petitioner. On perusal of the impugned order, I find no any illegality amounting to abuse of the process of the Court. Accordingly, this application is dismissed. However, petitioners would be at liberty to raise all points, raised herein, at appropriate stage in trial court. (Rajendra Kumar Mishra, J) Safik/-
