CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 4 15-04-2013 Heard learned counsels for the petitioner and the State. The petitioner being husband of the informant is apprehending arrest in a case registered for the offences punishable under Sections 498A,313 and 494/34 of the Indian Penal Code. The accusations are of torture for non fulfillment of dowry demands, performing second marriage and getting the pregnancy of the informant terminated. The matter was referred to the Mediation Centre. The report of the Mediation Centre at Flag B reflects that the matter has been reconciled between the parties under certain conditions. Let the same be transmitted to the learned court below. The parties are present and admit to have resolved the issue. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or Patna High Court Cr.Misc. No.21101 of 2012 (4) dt.15-04-2013 surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Jehanabad in connection with Arwal P.S. Case No. 223 of 2011 subject to the conditions as laid down under Section 438(2) Cr.P.C. The learned court below, while accepting the bail bonds, will incorporate the terms and conditions of agreement between the parties and in case of violation of the same, the learned court below will be at liberty to cancel the bail bonds.
