The petitioner is stated to be a Jansewak posted at the Block at Aurangabad. He is aggrieved by denial of his arrears of salary. Payment of salary is a statutory right. If the Government servant is discharging duties then unless there be any final orders in accordance with law, salary cannot be withheld. Right to salary in accordance with is a fundamental right under Article 21 of the Constitution of India. A Government Servant works to earn living. Unless there be justification, it cannot be denied. 2 Patna High Court CWJC No.909 of 2012 (2) dt.10-02-2012 Let the District Agriculture Officer, Aurangabad examine the grievances of the petitioner and pass appropriate orders within a maximum period of three weeks from the date of receipt/production of a copy of this order. If he finds justification in the claim or in any part of the claim, necessary consequential orders shall be passed simultaneously and payments, if any, be made in accordance with law.
