JUSTICE ASHWANI KUMAR SINGH ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 11 28-10-2013 These Appeals under Clause 10 of the Letters Patna High Court LPA No.1446 of 2011 (11) dt.28-10-2013 9/10 Patent have been preferred with the permission of the Court to challenge the order dated 23rd August 2011 made by the learned single Judge in CWJC No. 2192 of 2007. Learned advocate Mr. Prarap Sharma has appeared for the appellants. He has submitted that the subject matter of challenge in the Writ Petition was the Advertisement No. 1 of 2004 issued by the District Collector, Banka for recruitment to Class IV Posts in the District Offices of the State Government under the District Collector. The appellants and such others, who were already appointed under the said recruitment process, were not made party respondents. Nevertheless, the learned single Judge has, under the impugned order, directed that such appointments be cancelled after giving notice to the appointees. It is the case of the appellants that in compliance with the said order, the appellants were given notice of termination of service. Therefore, the Appeals. Pending the Appeals, under order dated 24th October 2011, the respondent authorities were directed to maintain status quo in respect of the service conditions of the appellants. In view of the said direction, the appellants still continue in Class IV service under the District Collector, Banka. There is no gainsaying that the impugned order dated 23rd August 2011 has been made ex parte against the appellants. The Appeals are required to be allowed on that short ground alone. For the aforesaid reason, the Appeals are allowed. The impugned order dated 23rd August 2011 made by the learned single Judge in CWJC No. 2192 of 2007 is set aside. CWJC No. 2192 of 2007 is revived and remitted to the learned single Judge Patna High Court LPA No.1446 of 2011 (11) dt.28-10-2013 10/10 according to roster for hearing and decision afresh. The respondent - writ petitioner will join the appellants herein and the other affected parties as party respondent in the above CWJC No. 2192 of 2007. The respondent State Government will file comprehensive counter affidavit with all supporting documents in
