JUSTICE RAVI RANJAN ORAL ORDER (Per: HONOURABLE DR. JUSTICE RAVI RANJAN) 3 01-02-2012 Re. I.A. No. 4120 of 2006 Heard the parties. This interlocutory application has been filed for expunging the name of the sole petitioner namely, Bishwanath Sharma, who is stated to have died on 19.07.2006 leaving behind his heirs and legal representatives as described in paragraph no. 2 of this application. None of the heirs and legal representatives have been shown as minor and a Vakalatnama has also been filed on behalf of their behalf. 2 Patna High Court CWJC No.10649 of 2005 (3) dt.01-02-2012 There is no opposition to the prayer of the petitioner. As a result, this application is allowed. Let the name of the deceased petitioner, namely, Bishwanath Sharma be expunged and in his place his legal representatives as described in paragraph no. 2 of this application be substituted. Now I proceed to consider C.W.J.C. No. 10649 of 2005 on merit. Heard learned counsel for the petitioners and the respondents. Learned counsel for the petitioners submits that a Title Suit No. 4 of 2005 has been filed by the father of the petitioners, which is pending before the 4th Munsif, Chapra for the redressal of the grievance and as such they do not want to press this writ application. Accordingly, this writ application is dismissed as withdrawn. However, since another interlocutory application bearing I.A. No. 6273/2007 has been filed on behalf of about six persons mentioned therein for their impleadment as respondents in this case and it is submitted by the petitioners that they are the defendants in the aforesaid title suit, I, ex debito justitiae 3 Patna High Court CWJC No.10649 of 2005 (3) dt.01-02-2012 direct the concerned court to take steps for expeditious disposal of the Title Suit No. 4 of 2005.
