The petitioner apprehends arrest in a case registered for the offence punishable under sections 366A of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that the girl in her 164 Cr.P.C. statement has stated that out of her own free will she had gone with the petitioner and has solemnized marriage with him. Her age has been assessed as 18 years. Petitioner claims clean antecedent.

Considering the 164 Cr.P.C. statement of the victim, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the Patna High Court CR. MISC. No.48290 of 2023(2) dt.22-08-2023 petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Beguserai in Mufassil Police Station Case No. 183 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure. shashi/- U T (Prabhat Kumar Singh, J)
