In order to appreciate the grienvance of the petitioners it would be also useful to quote the order of the Tribunal which is sought to be implemented under the directions of this Court. In the considered opinion of this Court the order dated 13.3.2013 passed by District Teachers Employment Appellate Tribunal, Bhojpur (hereinafter referred to as the Tribunal) in case no. 88 of 2012 is wholly disappointing. These Tribunals were constituted to decide and in fact adjudicate the disputes and they were definitely not expected to function alike the executive authorities. The facts present case in fact again will once again go to show that as to how these Tribunals as a whole have failed to decide the issue only on the plea that it was not given any proper assistance by the respondent officials. 4. The first and foremost thing in the case of the petitioners while deciding their claim for payment of salary was as to whether the Panchayat Shiksha Mitra who had not been allowed to continue as on 1.7.2006, could be restored back on the post of Panchayat Teacher by way of retrospective Patna High Court CWJC No.18480 of 2013 (2) dt.24-10-2013 5 withdrawal of their termination order. The Tribunal in fact while passing the impugned order has relied basically only on the averments made by the petitioners and therefore, even when it has noted that all the petitioners were removed from the post of Panchayat Shiksha Mitra from service well before 1.7.2006 and yet the issued has been left undecided inasmuch as the tribunal in its impugned order has not said a word as to whether such order of termination of the petitioners would stand approved or otherwise. 5. The payment of salary to any teacher including the Panchayat Shiksha Mitra after being absorbed as a Panchayat Teacher would primarily depend on two aspects firstly, as to whether such initial engagement of Panchayat Shiksha Mitra and absorption on the post of Panchayat Teacher was in accordance with law and whether the person concerned had worked on the basis of a valid appointment. The Tribunal here also has virtually left the matter undecided. 6. Thus now when the present writ application has been filed seeking writ of mandamus for implementing such order of the Tribunal, this Court would find it difficult to direct the authorities to comply such order of the Tribunal which itself to say the least is wholly perfunctory. That being so, the impugned order dated 13.3.2013 passed by the Tribunal in Case no. 88 of 2012 is quashed and the matter is remitted back to the Tribunal for deciding the issues in the complaint filed by the petitioners strictly in accordance with law and in the light of the Government Decision as with regard to continuation of Panchayat Shiksha Mitra and their absorption on the post of Panchayat Teacher in terms of Rule-20(iii) of Bihar Panchayat Teacher Appointment Rules-2006. 8. The District Education Officer, Bhojpur is also hereby directed to instruct the B.E.O, Udwant Nagar to ensure that all the necessary information regarding engagement of the petitioner as Panchayat Shiksha Mitra is made available to the Tribunal within a period of one month from the date of receipt of this order. If the Tribunal would require assistance of any other officer including the respondent nos. 4 to 8, it would also direct them to supply such information and in the event such information is not furnished by anyone of them appropriate disciplinary action be taken against them by respondent no. 3, the District Magistrate-cum-Collector of Bhojpur district. The whole aforesaid exercise by the Tribunal must be completed as early as possible preferably within a period of six months from Patna High Court CWJC No.18480 of 2013 (2) dt.24-10-2013 7 the date of receipt of this order. 9.
