12.10.2010 Heard learned counsel for the petitioner and the State. The offence alleged is under Section 498A of the Indian Penal Code and sections 3 & 4 of the Dowry Prohibition Act. It is submitted that the present case has been lodged for ulterior purposes in the year 2005 whereas the marriage was solemnized in the year 1993. It is further submitted that the present false case has been lodged for the offence which is alleged to have taken place in the year 1994. Considering the facts and circumstances of the case, it is directed that in the event of arrest or surrender within a period of four weeks from today, let the petitioner, above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Bettiah, West Champaran in connection with Complaint Case No. 2771-C/05, trial no. 427/10 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
