The submission of the learned counsel for the petitioner that since the petitioner was granted further extension after completion of his initial tenure, his services could not have been terminated in the midst of the tenure has to be also noted for being rejected because after it was discovered that the petitioner had Patna High Court CWJC No.19287 of 2012 (7) dt.28-02-2013 5 committed forgery by producing a false mark-sheet, the entire enquiry as noted above in the impugned order was conducted wherein after receipt of the letter of the institution in question, already quoted above, it was held conclusively that the petitioner had produced a forged mark-sheet. In fact the authority having held so ought to have directed for filing of a criminal case against the petitioner because if someone obtains employment on the basis of forged mark-sheet he also becomes liable for being criminally prosecuted in addition to being removed from the job. This Court, accordingly, would direct the District Programme Officer, the author of the impugned order, to institute a First Information Report against the petitioner for a primafacie criminal offence committed by him in obtaining his employment.
