The prayer of the petitioners in this writ application reads as follows:- "Commanding upon the respondents to appoint the petitioners as Auxiliary Nurse Midwifery (hereinafter referred to as the "ANM") on regular basis against the vacancy existing since 1996 and further onwards till the date since the petitioners are successful candidates of the year 1996 combined competitive examination and even thereafter the petitioners were compelled to file C.W.J.C. no. 11096 of 2001 which was allowed by judgment and order dated 22.2.2005 by this Hon'ble Court and this Hon'ble Court was pleased to hold that for the latches on the

Learned counsel appearing on behalf of the petitioners has submitted that since the brochure issued by the Bihar Public Service Commission for giving admission to the petitioners and others had included a clause that after the completion of the course, the candidates would be under an obligation to serve the State of Bihar for a period of five years failing which they will have to return the amount incurred on their admission and training in the course of ANM, they would constitute a separate class and therefore, would be entitled for their straightway appointment without subjecting them to any sort of selection. In the considered opinion of this Court, there can be no such provision for direct appointment on the post of ANM specially when the cadre Rules have been framed way back by issuance of departmental resolution no. 435(6) dated 10.06.1996, wherein, it is the Bihar Staff Selection Commission which has been vested with the power of conducting the selection and recommending the candidates for the post of ANM. In fact this aspect of the matter having been raised by the petitioners earlier in C.W.J.C No. 3045 of 2008 was gone into by the Director-in-chief of Health Patna High Court CWJC No.17021 of 2013 (2) dt.11-09-2013 3 Services in a very elaborate manner and this Court having perused the reasoning therein would find nothing objectionable much less erroneous to interfere with the same. If the Government has made new cadre Rules, the petitioners cannot be blamed for that and they cannot be subjected to any recovery. With the aforementioned observation and direction,
