17.03.2009. Heard the counsel for the petitioners and the Vigilance. Petitioners though have not been named in the First Information Report of Special Case No. 30 of 2005 arising out of Vigilance P.S. Case No. 019 of 2005. They are apprehending their arrest. During investigation their names have also been roped in this case. Counsel for the petitioners submits that allegation against the petitioners is that they used eraser more than 80 times. The persons who used eraser for 50 times they have been exempted. Other similarly situated persons have been granted anticipatory bail. Considering these facts, the prayer for Anticipatory bail on behalf of the petitioners is allowed. In the event of arrest or surrender within four weeks from today, the petitioners Shyamanand Sah in (Cr. Misc. No. 6399 of 2009), Shri Niwas Singh in (Cr. Misc. No. 7338 of 2009), Mitali Chakrawarti, Kala Nand Singh, Vijay Kumar, Awadhesh Kumar Singh and Prem Shankar Yadav in (Cr. Misc. No. 8439 of 2009), Sheela Kumari, Md. Noor Alam, Umesh Ranjan Dev, Santosh Kumar Nandkuliar and Shiv Kumar Prasad in (Cr. Misc. No. 8580 of 2009), Thakur Ramashish Prasad, Dipak Sah, Dinesh Kumar, Shyam Narain Singh, Binod Kumar, Sanjay Kumar Sinha, Shyam Nandan Singh, Binod Prasad Karn, Bimal Kumar, Mohan Kumar Sinha and Safdar Imam in (Cr. Case No. 019 of 2005 subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure on this condition that the petitioners will co-operate in the trial and will attend the court regularly.
