JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 9 18-07-2013 The petitioner has approached this Court under Article 226 of the Constitution of India assailing the validity and correctness of the notice dated 23.11.2007 (Annexure-3) issued by the respondent D.C.L.R., Lakhisarai, in Jamabandi Cancellation Case No. 22 of 2006-07. Apparently, the claim raised on behalf of the petitioner with respect to in dispute and issue regarding cancellation of Jamabandi are yet to be finally adjudicated by the respondent D.C.L.R., Lakhisarai, and/or the other competent authority. In the considered opinion of this Court, the present writ petition is premature and is, accordingly, dismissed. However, the petitioner shall be at liberty to raise all the pleas which are available to him under the law and which have been raised in the present proceeding before the competent authority. It is expected that the pleas raised on behalf of the Patna High Court CWJC No.908 of 2008 (9) dt.18-07-2013 2 petitioner shall be gone into by the competent authority, if the proceeding is still pending, and shall be decided by a reasoned and speaking order. The petitioner is hereby directed to appear before the respondent D.C.L.R., Lakhisarai, with a certified copy of the present order within a period of one month from today, and he may pursue his remedy before the competent authority.
