4 Learned counsel for the petitioner submits that after investigation, police submitted charge sheet against co-accused Bikram Singh and Karu Singh. However, there was no material Patna High Court CR. MISC. No.43006 of 2023(2) dt.04-08-2023 found against the petitioner and the final form was submitted before the Court concerned but the Court concerned has taken cognizance against the petitioner also. He has further submitted that petitioner has no criminal antecedent and he has been falsely implicated in this case due to land dispute. It is also submitted that there is no material in the case diary against the petitioner. bail. 5 Learned APP opposes the prayer for anticipatory 6 Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount to each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Fatehpur PS Case No 426 of 2022, subject to the conditions as laid down in Section 438 (2) of the Code of Criminal Procedure, 1973.
