2. The petitioners apprehend their arrest in a case, registered for the offences punishable under Sections 498A, 341, 323, 504, 506, 494, 379 and 34 of the Indian Penal Code and section 3/4 of the Dowry Prohibition Act.
3. Allegation against petitioners is of commission of torture and harassment upon the informant for dowry.
It is submitted that thrust of accusation is against husband of the informant who is already in custody. Petitioners are cousin brother-in-law of the informant. There is no specific Patna High Court CR. MISC. No.45733 of 2023(2) dt.10-08-2023 allegation against petitioners rather allegation is general and omnibus. Petitioners are separate in mess and property and have got no concern with the family affairs of the informant and her husband. Petitioners claim clean antecedents.
Considering the facts aforesaid, the petitioners above-named, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Supaul in connection with Supaul Mahila P.S. Case No. 17 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) vinita/- U T
