5.5.2010 Learned Government Advocate No.1 files a supplementary counter affidavit on behalf of the Deputy Secretary-cum- Director, Urban Development and Housing Department, Bihar, Patna, in which it is stated that the Municipal Building Tribunal has been constituted at all the Divisional Headquarters as per the provisions of Section 329 of the Bihar Municipal Act, 2007, with respect to which notifications dated 30.4.2010 have been issued, Superintendent, Government Press, Gulzarbagh for publication in the Official Gazette. In aforesaid developments, learned counsel petitioner seeks permission to withdraw the writ application with liberty to approach the Municipal Building Tribunal for appropriate relief. The writ application is, accordingly, dismissed as withdrawn with the aforesaid liberty. - 2 - The present order has been passed in the presence of learned counsel for private respondent No.10 and learned counsel for the P.R.D.A.(Now Patna Municipal Corporation).
