since the decision of this Court in the matter of Brajesh Kumar (supra) the matter at issue was considered by a Full Bench of this Court headed by the Chief Justice Mr. Dipak Misra (as he then was) in the matter of State of Bihar and Ors. V. Rajeev Ran Vijay Kumar, {2010(3) PLJR 294}. JUSTICE ASHWANI KUMAR SINGH ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 10. 14.08.2013 This group of Appeals preferred by the respondent State Government under Clause 10 of the Letters Patent arise from the orders made by the learned single Judge in concerned writ petitions. The matter at issue is the appointment of the writ petitioners as Panchayat Teachers/Prakhand Teachers on consolidated pay on compassionate ground. Each petitioner claimed to be a dependent member of the family of an Assistant Teacher in Government school who died in harness. According to the prevailing scheme for compassionate employment each petitioner claimed compassionate employment in government service. Instead of offering compassionate employment in a regular pay-scale in State service, each petitioner was offered appointment as Panchayat Teacher/Prakhand Teacher on a consolidated pay as envisaged by the relevant rules framed in 2006. The petitioners did accept the employment offered to them, but under protest. Each petitioner approached this Court under Article 226 of the Constitution in respective writ petition for a direction to the respondent authorities, the appellants, to appoint the petitioner on the post of teacher in the prescribed pay-scale as recommended by the District Compassionate Appointment Committee. The learned single Judge has, following the judgment in the matter of Brajesh Kumar v. the State of Bihar 39 Patna High Court LPA No.925 of 2010 (10) dt. 14-08-2013 39 / 42 & Ors., {2010(1) PLJR 339}, allowed the writ petitions. The learned single Judge has held that the petitioners are entitled to compassionate employment in Class-III or Class-IV service in regular pay-scale depending upon their qualifications. The learned single Judge has, therefore, directed the appellants to appoint the petitioners on any government post in a regular pay- scale of an Assistant Teacher. The District Compassionate Appointment Committee is directed to consider the cases of the petitioners for employment in government service. The appellants were also directed to consider the claim of the petitioners for arrears of salary in regular scale. Feeling aggrieved, the State Government and the District Compassionate Appointment Committee, Patna have preferred these Appeals. Learned advocate Mr. Prabhat Kumar Singh has appeared for the appellants. At the outset, he has submitted that

orders made on the writ petitions stand overruled and require to be set aside as a matter of course. Learned advocate Mr. Alok Ranjan has appeared for the respondent petitioners. He has contested the Appeals. He has submitted that the petitioners are the dependent members of the family of the Assistant Teachers in Government schools who died in harness long before the State Government framed the Bihar Panchayat Elementary Teacher (Employment and Service Conditions) Rules, 2006. The cases of the petitioners, therefore, should be considered in accordance with the policy for compassionate employment prevalent at the relevant time. Their right to compassionate employment cannot be abridged or abrogated by the provisions contained in the Rules of 2006. He has also relied upon the order dated 9th August 2012 made by the Division Bench of this Court (to which one of us, the Chief Justice was a party) in Letters Patent Appeal No. 600 of 2011 arising from C.W.J.C. No. 18673 of 2009. Learned advocate Mr. Bishnu Kant Dubey has appeared for the respondent writ petitioner in Letters Patent Appeal No. 1137 of 2010. Mr. Bishnu Kant Dubey has relied upon the judgment of this Court in the matter of Prem Narayan and another v. State of Bihar & Ors., {1995(1) PLJR 216} and the Government Circular dated 27th April 1995. In re. Saket Suman and others (Letters Patent Appeal No. 600 of 2011), the claim of the writ petitioners for compassionate employment, pursuant to the death of their parents in 2004/2005, were considered by the District 41 Patna High Court LPA No.925 of 2010 (10) dt. 14-08-2013 41 / 42 Compassionate Appointment Committee in 2006. The said Committee recommended appointment of the writ petitioners in Class-III service under the State Government. Nevertheless, the concerned authority did not issue appointment order. The writ petition for a direction to issue appointment order was contested by the State Government. According to the State Government, since the framing of the Bihar Panchayat Elementary Teacher (Employment and Service Conditions) Rules, 2006, the appointment to the Government service on compassionate ground was not permissible and the only permissible employment was as a Panchayat Teacher/Prakhand Teacher under Rule 10 of the Rules of 2006. The contention was rejected by the Bench of this Court (to which one of us the Chief Justice was a party). The Court held that Rule 10 of the Rules of 2006 is an enabling provision and not a mandatory provision. In the matter of Prem Narayan and another (supra), a Bench of this Court has emphasized on expeditious employment on compassionate ground so as not to frustrate the purpose of the compassionate employment. The present matters are quite different from one in the matter of Saket Suman and others. In the matter of Saket Suman and others, the compassionate employment was recommended by the concerned Committee long before the Rules of 2006. However, for the reasons unknown, the appointment orders were not issued. In the present case, the writ petitioners were offered compassionate employment as Panchayat Teacher/Prakhand Teacher under the Rules of 2006 and they have accepted the said employment. At the outset, we may note that the compassionate 42 Patna High Court LPA No.925 of 2010 (10) dt. 14-08-2013 42 / 42 employment is neither a fundamental right nor a constitutional right nor a statutory right. The very concept of compassionate employment is an exception to Articles 14 and 16 of the Constitution and has to be treated as such. If in exercise of power conferred by Rule 10 of the Rules of 2006, the writ petitioners were offered employment as Panchayat Teacher/Prakhand Teacher on compassionate ground and they have accepted the same, may be under protest, their claim for compassionate employment stands satisfied. The writ petitioners could not have claimed employment in Government service in regular pay-scale on compassionate ground as an enforceable right. In view of the aforesaid Full Bench judgment; the writ petitions having been allowed following the judgment in the matter of Brajesh Kumar (supra), nothing further is required. The Appeals are allowed. The impugned judgments and orders of the learned single Judge passed in the respective writ petitions are set aside. The writ petitions are dismissed.
