Judgment

IN THE HIGH COURT OF JUDICATURE AT PATNA C. REV. No.16 of 2008 UNITED INDIA INSURANCE CO. LTD. Versus MANTI DEVI & ORS ----------- 05/

05.08.2008 I.A. No. 4293/2008 has been filed for condoning delay in filing of this civil review petition. Considering the averments made by learned counsel for the petitioner and the statements made in this interlocutory application, it appears that genuine reasons have been shown, which prevented the petitioner from filing this civil review petition earlier. Accordingly, I.A. No. 4393/3008 is allowed and the delay in filing of this civil review petition is condoned. This civil review petition has been filed for review of order dated

02.04.2007 dismissing M.A. No. 501 of 2004 filed by the petitioner challenging order dated 16.08.2004 passed by the Deputy Labour Commissioner-cum-Commissioner under the Workmen’s Compensation Act, 1923, by which W.C. Case No.17/2003 filed by the claimants was allowed. From the averments made by learned counsel for the petitioner and the materials on record, it appears that neither there was any error apparent on the face of the record nor any material could be brought, which was not available with the petitioner earlier when the said order was passed nor does this Court find any sufficient reason to review its earlier order dated 02.04.2007. In the said circumstances, this Court does not find any merit in this civil review petition, which is, accordingly, dismissed. MPS/ ( S. N. Hussain, J. ) - 2 -
