JUSTICE DINESH KUMAR SINGH ORAL ORDER 2 07-10-2013 Heard learned counsels for the petitioners, informant and the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 323, 326, 342 and 504/34 of the Indian Penal Code. It is alleged that on the order of petitioner no. 1, petitioner no. 2 caused acid burn injury to the informant. It is submitted that accusation is not specific against petitioner no. 2 though the injury has been found to be simple. This Court is not inclined to grant anticipatory bail to petitioner no.2. Let the learned court below consider regular bail of petitioner no. 2 if he surrenders within a period of six weeks from the date of receipt of copy of this 2 Patna High Court Cr.Misc. No.29669 of 2013 (2) dt.07-10-2013 order in connection with Saharsa P.S. Case No. 100 of 2013 pending in the court of the learned C.J.M. Saharsa. With this observation, the application of petitioner no. 2 is disposed off. Let the order be faxed to the learned court below at the cost of the petitioners. Considering the fact that overt act has not been alleged against petitioner nos. 1, 3 and 4 let them except petitioner no. 2 be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Saharsa P.S. Case No. 100 of 2013 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M. Saharsa, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. U.K./- (Dinesh Kumar Singh, J)
