JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 2 28-10-2013 Heard learned Counsel for the petitioners and the learned Additional Public Prosecutor for the State. The petitioners apprehend arrest in a case registered for the offence punishable under Sections 147, 148, 149, 353, 307, 387, 379, 427, 504, 435, 120(B) of the Indian Penal Code. Islampur Police Station Case No. 144 of 2013 was instituted on the basis of the self-statement recorded by the Sub-Inspector of Police, Islampur Police Station. From the First Information Report, it appears that against the road accident caused by a truck, the local people were protesting. It is alleged that nearly 200-250 persons armed with lathi, Patna High Court Cr.Misc. No.44516 of 2013 (2) dt.28-10-2013 danda challenged the Police and district administration and allegedly they attacked the informant and other police personnel in order to snatch their arms and ammunitions. The petitioners are named the First Information Report. Learned Counsel appearing on behalf of the petitioners submits that it is true that the petitioners are named in the First Information Report, but there is no specific overt act alleged against them, though such allegation is there against one Kaushal Singh. He submits that no injury was caused to anyone in the said occurrence. In view of the above, let the above named petitioners be released on bail in the event of his arrest or surrender before the Court below within a period of six weeks from today in connection with Islampur Police Station Case No. 144 of 2013 on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Hilsa, Nalanda subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
