CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 2 09-10-2012 Heard learned counsel for the petitioner and learned A.P.P. for the State. The petitioner is accused in Saharsa P.S. Case No. 295/2012 for the offence registered under sections 420, 467, 468/34 of the Indian Penal Code. The allegation against the petitioner is to sell the land of complainant Suresh Yadav which was purchased by him from Shatrughan Mistri. Learned counsel appearing on behalf of the petitioner submits that the petitioner has purchased the disputed land from Shatrughan Mistri through registered sale deed prior to its purchase by the complainant. It is further submitted that the informant has already filed Title Suit No. 213/2011 in the court of Subordinate Judge, Saharsa, regarding the said land in which the petitioner is one of the defendants. In the facts and circumstances of the case, the Patna High Court Cr.Misc. No.37487 of 2012 (2) dt.09-10-2012 2 petitioner, namely, Ranjan Yadav is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa.
