09-05-2013 This Civil Revision application is directed against the order dated 04.11.2009 passed by learned 1st Additional District Judge, Bhagalpur in Claim Case No. 47 of 2006, whereby the petition filed by the petitioner-Insurance Company under Section 169(2) of Patna High Court C.R. No.2197 of 2009 (4) dt.09-05-2013 2 the Motor Vehicles Act, 1988 (hereinafter referred to as the ‘Act’), has been dismissed. This matter was earlier heard on 26.03.2012 when it was submitted on behalf of the opposite parties that the Claim Case itself had been disposed of and thus on the request made by Mr. Durgesh Kumar Singh, learned counsel appearing for Insurance Company, the matter was adjourned. Mr. Singh today admits to the position and submits that the Insurance Company since after disposal of the claim case has filed a statutory appeal bearing M.A. No. 358 of 2012 and which is pending consideration before a Bench of this Court. It is further submitted by Mr. Singh that the issue raised in the present application has also been raised in the Miscellaneous Appeal. In that view of the matter, nothing is required to be done in the present matter and it is accordingly disposed of. S.Sb/- (Jyoti Saran, J)
