12-09-2012. Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the Accountant General, Bihar. The petitioner has approached this court for payment of remaining amount of G.P.F. with statutory interest at the rate of 12.5 % per annum for the period 1985-86 to 1998-99 and also for revision of the pension and gratuity pursuant to the second time bound promotion granted to the petitioner. So far as the prayer for payment of arrear amount of salary to the petitioner is concerned, he may approach the appropriate authority for the redressal of his grievance or take Patna High Court CWJC No.7453 of 2012 (4) dt.12-09-2012 2 recourse to appropriate proceedings, including another writ petition. In the counter affidavit filed on behalf of the State, it has been stated that authority for payment of Rs.16,953/- as the arrear of G.P.F with statutory interest at the rate of 12.5 % has been sent to the Treasury Officer, Sasaram for passing the bill and to credit the said amount in the Bank account of the petitioner. Learned counsel for the petitioner submits that the aforesaid amount has not been received by the petitioner. In the counter affidavit it is stated that on account of second time promotion being granted to the petitioner, no revision of the pension and gratuity is required as due to pay revision his last pay is not affected. Learned counsel for the petitioner has not disputed the said position. In the aforesaid circumstances, the writ application is disposed of with a direction to the respondents to ensure that the GPF amount is credited in the bank account of the petitioner within a period of six weeks from today. ahk/- (Ramesh Kumar Datta, J.)
