The petitioner seeks bail in connection with Agiaon Bazar PS Case No.55 of 2024 dated 27.04.2024 instituted for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Amendment Act, 2022.
The allegation is of recovery of 100 litres country made mahua liquor from the tempo.
Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Learned counsel further submitted that the petitioner is either driver nor owner of the auto. He has no concern with the auto. Petitioner was the bonafide passenger of the auto. The Patna High Court CR. MISC. No.40382 of 2024(3) dt.26-07-2024 petitioner has no concern with the aforesaid recovery. Charge- sheet has been submitted in the case. Petitioner is in custody since 28.04.2024 having no criminal antecedents.
Learned APP has opposed the prayer for bail.
