JUSTICE JAYANANDAN SINGH) 4 02-02-2012 Petitioners of all these writ applications claim to be teaching and non-teaching staff of Intermediate Colleges affiliated erstwhile with Intermediate Council. Earlier these Colleges were unaided Colleges. Their cause of action has now arisen because the State Government has taken a policy decision on 26th March, 2008 to release aid to such Colleges. The grievance is that after the Colleges have started receiving aid, Managements of the respective Colleges has 12 Patna High Court CWJC No.19787 of 2010 (4) dt.02-02-2012 P12 / 13 started making interpolations in the records of the Colleges to deprive them of their legitimate dues and inserting new names in the records for undue benefit to their favourites. Hence, they have approached this Court for a direction to the respondents to get an enquiry held and ascertain the genuine employees of the respective Colleges working from before who are entitled for release of payment and to direct for release of payment to only such employees. This dispute cannot be examined and decided by this Court in exercise of jurisdiction under Article 226 of the Constitution of India. Hence, this Court considers appropriate that some authority of the Government who is responsible for release of aid to these Colleges should get the matter enquired into in respect of each of the College and identify the genuine employees for payments from the aid released by the Government in accordance with law before the aid is released in favour of the Colleges and the employees. In the circumstances, these writ applications are disposed of with a direction to the Director, Secondary Education to apply his mind to this problem arising virtually in each of the Colleges which are now getting aid from the government and ensure the aid released by 13 Patna High Court CWJC No.19787 of 2010 (4) dt.02-02-2012 P13 / 13 Government is not misused by the management and the payment of the same is released only in favour of the employees who were validly appointed in the Colleges at the relevant time and have continued there since then. For this purpose, the Director, Secondary Education, either may constitute a Committee or may appoint responsible persons as Inspectors for examining the records and may also call for relevant records in respect of each of the Colleges from the office of the erstwhile Intermediate Council whose functions have now been taken-over by the Bihar School Examination Board (Senior Secondary). The Director, Secondary Education shall also consider as to in particular facts and circumstances of the case whether it is desirable to restraint the Managing Committee from withdrawing fund and disbursing the same till the enquiry is completed.
