Heard learned counsel for the petitioner and the State. The petitioner is one of the named accused person of a case which has been registered under section 366A/34 of the Indian Penal Code on the basis of written application of Kailasi Devi, who alleged that her minor daughter Savita Devi aged about 16 years was found missing from the house in the night. The informant came to know that she has been taken away by this petitioner and two others, namely, Birendra Singh and Nageshwar Singh. Submission is that the alleged victim in her statement under section 164 Cr.P.C. stated that she was taken away by this petitioner and Birendra Singh to different places but no body established physical relationship with her. Birendra Singh has been granted bail by this court on 24.9.2008 in Cr.Misc. No.28553 of 2008. The case of the petitioner is more or less on similar footing to that of Birendra Singh. Considering the facts and circumstances of the case the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jamui in connection with Chakai P.S.Case No.84 of 2007.
