learned Counsel appearing on behalf of the State. The petitioner is sole named accused and apprehends his arrest in a case which has been registered under Section 411 of the Indian Penal Code and Sections 25(2) read with Sections 14(3) of the Antiquities and Art Treasure Act, 1972. Allegation against the petitioner is that from his house one idol of Lord Bishnu was seized. It was suspected to be stolen idol from Patna Museum. Submission is that with regard to theft of idols C.B.I. has registered a case. The petitioner was apprehended in that case. The C.B.I. found that the seized antique from the house of the petitioner was not antique or stolen. So he was found to be innocent. For the same offence he has been robbed in by the informant. Considering the facts and circumstances of the case, the above named petitioner is directed to surrender before the Court below within a period of twenty days from the date of receipt/production of a copy of this order - 2 - and on his so surrendering he shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in connection with Tekari P.S. Case No. 85 of 2007, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. kksinha/ (Shyam Kishore Sharma, J.)
